These Terms and Conditions govern your use of thegreenpods.co.nz and your purchase of products from The Green Pods, a trading name of Balme Enterprises Ltd (registered in New Zealand, registered address 6B Brookfield Terrace, Tauranga 3110, New Zealand). By using our website or placing an order, you agree to these Terms.

1. Definitions

“We”, “us” and “our” mean Balme Enterprises Ltd trading as The Green Pods. “You” means the person browsing our website or placing an order. “Products” means the goods offered for sale on our website.

2. Orders and contract

When you place an order, you make an offer to purchase the Products subject to these Terms. A contract is formed only when we accept your order and dispatch the Products. We may decline or cancel an order (for example, if a Product is out of stock, incorrectly priced, or we suspect fraud), and if we do, we will refund any payment already made.

3. Prices and payment

Prices for orders shipped within New Zealand are shown in New Zealand Dollars (NZD). We accept payment by Stripe, PayPal, Afterpay and direct bank transfer. Payment is processed securely by our third-party payment providers. Title to the Products passes to you on full payment; risk passes on delivery.

4. Shipping and delivery

Delivery times and costs are set out in our Shipping Policy, which forms part of these Terms. Delivery estimates are indicative only and not guaranteed.

5. Returns, refunds and your consumer rights

Our Refund and Returns Policy forms part of these Terms. Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where they apply. Where you are acquiring Products as a consumer, our Products come with guarantees that cannot be excluded under New Zealand consumer law. In addition to your statutory rights, we offer a 30-day change-of-mind returns policy as set out in our Refund and Returns Policy.

6. Product information

We take care to describe and picture our Products accurately, but minor variations may occur and colours may display differently across devices. We do not warrant that product descriptions or other content are error-free.

7. Intellectual property

All content on this website, including text, images, logos and design, is owned by or licensed to us and is protected by intellectual property laws. You may not reproduce or use it without our written permission.

8. Acceptable use

You agree not to use our website unlawfully, to attempt to gain unauthorised access, or to disrupt its operation or security.

9. Limitation of liability

To the maximum extent permitted by law, and without limiting your rights under the Consumer Guarantees Act 1993, we are not liable for any indirect, incidental or consequential loss arising from your use of our website or Products. Nothing in these Terms excludes liability that cannot lawfully be excluded.

These Terms are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts.
